GENERAL TERMS AND CONDITIONS APPLICABLE TO THE VEHICLE INSPECTION WEBSITE

It is hereby indicated to Users of the Vehicle Inspection website that the Site is published and stored by SGS GROUP MANAGEMENT SA, a Company having its registered office at 1 Place des Alpes, 1211 Geneva 1, Switzerland. 1. OBJECT

The present General Terms and Conditions are intended to outline the terms and conditions in line with which SGS, on the one hand, makes available to Users the VEHICLE INSPECTION website at www.SGS.COM and, on the other hand, how Users access and use Services, outlined hereunder, made available on the VEHICLE INSPECTION website.

SGS makes available to Users access to a joint information platform allowing for supervision information about mandatory vehicle inspection, list of vehicle test centres where the user can have his vehicle inspected, a contact/complain form to request information or make complains, an online booking system, free reminder for the next vehicle inspection.

2. GENERAL PROVISIONS

Acceptance of the present General Terms and Conditions shall presume that Users have the legal capacity required or, failing that, the authorisation of a guardian or tutor if incapable, or that they hold a mandate if acting on behalf of a legal entity.  

3. TERMS AND CONDITIONS OF SUBSCRIPTION TO SERVICES

In order to subscribe to Services, Users should follow the indications present on:

  • the contact/complain form available on the Website.
  • the online booking form or available on the Website.
  • the free reminder form available on the Website.

Users hereby undertake to communicate to SGS precise information and to update details immediately following any change. SGS shall not be held liable in such instance as it has not been informed of any change to the circumstances of the User.

A subscription for the online booking will be transmitted to the relevant SGS Vehicle Test centre. The user will be contacted by the relevant SGS Vehicle Test centre to confirm whether or not the booking request can be accommodated. A booking request does not constitute a confirmed booking until you are contacted via email or phone by the relevant SGS Vehicle Test centre to confirm the booking. SGS shall bear no liability for non-transmission or any errors in the transmission of the information entered in the form to the relevant SGS Vehicle Test centre.

A subscription for the free reminder is valid until the date of validity of the vehicle inspection. An email notification will be sent to user who has subscribed to the service at least 10 days before the end of validity of the vehicle inspection so that user is aware of the upcoming end of validity and can take necessary actions to book his next test.

SGS may suspend or terminate subscription in the event of default by the User in respecting the rules of use of the VEHICLE INSPECTION website as outlined in the present General Terms and Conditions.

 

5. PROVISIONS PERTAINING TO SUBSCRIPTION

By subscribing to the services on the website, the User hereby undertake to communicate precise data. In case SGS does not receive correct data from the User, the User will not receive answer to his question/complain, booking request or Reminder notification.

SGS may suspend or terminate subscription in the event of default by the User in respecting the rules of use of the VEHICLE INSPECTION website as outlined in the present General Terms and Conditions.

6. TERMS AND CONDITIONS OF USE OF THE VEHICLE INSPECTION WEBSITE BY THE USER

Users hereby undertake without any limitation or reservations as follows:

  • To use services provided by SGS pursuant to the present General Terms and Conditions;
  • To respect all rights of third parties;
  • To respect all legislative or regulatory provisions in force.

All Users shall remain, in all instances, responsible for the data communicated. They shall remain responsible for their actions undertaken in the framework of use of the Services and shall be answerable therefor before the courts.

7. NOTICES PERTAINING TO THE DATA PROTECTION

Users shall have the free and unrestricted right to provide personal information. The supply of personal information is not essential for navigation on the website. However, subscription to the present Website requires the collection, by SGS, of a certain number of personal information concerning Users. Users who do not wish to provide the information required for use of Services offered by the present Website in addition, where applicable, to the creation of a personal space, may not use the services proposed by SGS nor place any order on the present Website.

Data collected is required for due and proper administration of services offered on the present Website in addition to respect of contractual obligations by SGS. This data is retained by SGS in this unique capacity, and SGS hereby undertakes not to use the data for any other purposes, nor to communicate these to any third parties without the express consent of users of for those purposes for which provision is made by law.

Data concerning all users subscribed to the present Website is stored for a term of one year, which is the term deemed to be reasonably necessary for due and proper administration of the website and for normal use of data. This data is retained under secure conditions in line with current technical resources.

Users have a right to oppose, enquire, access and modify data provided. In this regard, it is necessary to make a request to SGS, by writing to the following address:  automotive@sgs.com. None of the personal data collected is sent abroad.

Moreover, SGS hereby reserves the right to collect the public IP (Internet Protocol) address of all Users. The collection of this IP address shall be undertaken anonymously, and shall be retained for the same term as all personal data and shall only be used to ensure due and proper administration of services offered on the present Website. The IP address corresponds to a series of individual numbers of points which allow for the unique identification of a computer on the Internet network.

SGS should communicate all personal data pertaining to any User to the Police (following a legal order) or to any person (following a ruling by a judge. The IP address of your computer may be cross-referenced with the actual identity of the subscribed member as held by the ISP (Internet Service Provider).

8. RELINQUISHMENT OF LIABILITY OF SGS IN THE FRAMEWORK OF PERFORMANCE OF THE PRESENT CONTRACT

SGS shall strive to make its Services accessible 24/7. However, for all services proposed, Users hereby agree that SGS shall be subject to an obligation of means. Users hereby recognise moreover that in the current technical conditions, and in the absence of any guarantees from telecommunications operators or software editors, the permanent availability of Services cannot be guaranteed. Moreover, SGS may suspend, at any time and without notice, access to its Services for reasons of maintenance or updates.

In the event of inability to access the website, due to technical problems or other problems of any nature whatsoever, Users may not claim any entitlement to compensation.

9. INTELLECTUAL PROPERTY RIGHTS PERTAINING TO INFORMATION PUBLISHED ON THE PRESENT WEBSITE

All information included on the present Website, including maps placed online and the corresponding reports, belong to SGS and are in this regard protected by legislation pertaining to intellectual property.

It should therefore be recognised that in the absence of any authorisation, any copy, in whole or in part, and any distribution or use of one or more items of this information, even modified, shall be likely to lead to legal redress against you or legal heirs.

This protection shall cover all textual and graphical content of the Website, but additionally the structure, name and style guide thereof.

10. MISCELLANEOUS PROVISIONS

The present General Terms and Conditions shall be subject to application of French law.

The present General Terms and Conditions may be modified at any time by SGS. The General Terms and Conditions applicable to Users are those in force at the date of order or connection to the Website. SGS hereby undertakes to retain all previous General Terms and Conditions and to send these to any User who requests receipt thereof.

In such instance as any clauses in the present General Terms and Conditions should be declared null and void by any legal decision, this invalidity may not lead to the invalidity of all other clauses, which shall continue to be applicable.

In such instance as SGS should not claim temporary or permanent enforcement of one or more clauses in the present General Terms and Conditions, this shall not lead to relinquishment in claiming performance of the remaining General Terms and Conditions.

Any dispute shall be refereed exclusively to the Courts in the jurisdiction of the Registered Office of SGS.
